These Terms & Conditions govern scheduling, participation, and program operations. They are separate from the Liability Waiver and Release.

Enrollment & Program Changes

In consideration of this enrollment and the payment of the appropriate fees, Sailing NYC LLC d.b.a. Atlantic Yachting (“Atlantic Yachting”) agrees to reserve a place and to hire instructors and supervisory staff. Atlantic Yachting reserves the right to make additions/changes/deletions in the program/facilities/procedure without notice or obligation.

Sailing is an outdoor activity, and conditions on the water can change quickly. For safety and operational reasons, Atlantic Yachting may adjust daily activities, schedules, locations, instructors, vessels, or procedures due to weather, water conditions, staffing needs, or other unforeseen circumstances. Every effort will be made to provide a full and engaging experience, even when adjustments are necessary.

Refunds & Rescheduling

Our program planning, staffing, and vessel scheduling are based on enrollment numbers, which means that rescheduling or cancellation requests may be subject to a fee. 

• Failure to attend does not constitute a refund.

If you need to change sessions, we’re happy to help when possible, subject to availability and the following change fees:

• 6+ weeks’ notice  before session start: No Fee
• 3–6 weeks’ notice before session start: 15% Fee
• 1–3 weeks’ notice before session start: 40% Fee
• Less than 1 week’s notice  before session start: No refund (100% Fee)

Participant Eligibility & Safety Requirements

Safety on the water is our top priority. To participate, all campers must:

• Be able to swim at least 100 yards unassisted
• Be able to tread water for at least 15 minutes
• Wear a U.S. Coast Guard–approved life jacket at all times while on the dock or aboard vessels
• Follow all safety instructions given by instructors and staff
  
  

These requirements are essential to ensuring a safe and enjoyable experience for everyone. By enrolling your child in this program, you affirm their ability to abide by these requirements. 

Conduct & Behavior Expectations

We strive to create a respectful, inclusive, and fun environment. Participants are expected to:

• Treat fellow campers, staff, and equipment with respect
• Use appropriate language
• Avoid horseplay or unsafe behavior
• Participate in basic vessel care and cleanup as part of the sailing experience.
  
  

Intentional damage to vessels, equipment, or facilities may result in dismissal from the program, and parents may be responsible for repair or replacement costs.

Atlantic Yachting reserves the right to dismiss a participant for safety or behavioral concerns without refund.

Personal Property & Electronics

Sailing and waterfront activities can be tough on personal belongings. We strongly recommend leaving valuables, including electronics, at home whenever possible.

If a camper brings a phone, it will be stored securely in a provided locked pouch and they will keep it in their bag during program hours. Atlantic Yachting is not responsible for lost, damaged, or stolen personal items.

Illegal & Controlled Substances

For the safety and comfort of all participants, the possession or use of illegal drugs, alcohol, tobacco

products, e-cigarettes, or vaping devices is strictly prohibited.

Prescription medications are permitted only if they are disclosed in advance and handled according to program policy.

Any violation of this policy will result in immediate dismissal from the program without refund.

Medical Care & Emergencies

Parents or guardians will be contacted if a participant receives professional medical attention. In the event of an emergency where a parent or guardian cannot be reached, medical care will be provided in accordance with the Medical Authorization Provision in the Liability Waiver and Release. All medical expenses incurred are the responsibility of the parent or guardian.

Transportation Authorization

From time to time, program activities or weather-related plans may require travel within Manhattan. By enrolling, parents and guardians authorize Atlantic Yachting staff to accompany and transport participants on foot, by subway, or by NYC taxi for program-related activities.

By enrolling your child in the program, you acknowledge that you have read, understand,and agree to these Terms & Conditions.
